Health Guarantee
Seller guarantees this dog to the best of their knowledge, to be healthy upon arrival to the purchaser. Purchaser has 72 hours from the date of purchase to have the dog checked by a licensed veterinarian. . However, any exam performed by a vet belonging to the Banfield network (Petsmart/Petco) will VOID this guarantee in its entirety due to their reputation of financial abuse of new puppy owners. Should your vet discover an illness or congenital defect at this time, a replacement or full refund of the purchase price (not including shipping) will be given provided the puppy is returned with a written statement from the vet stating the nature of their findings. It is the Buyer’s responsibility to return the puppy along with all registration papers and other puppy care and full package contents. SELLER SHALL NOT BE RESPONSIBLE FOR ANY MEDICAL EXPENSES THAT BUYER HAS INCURRED.
Seller guarantees that at the time of pick up the puppy will free of Coccidian, Giardia, Kennel Cough, worms, fleas, ticks, ear mites, and/or parasites of all kind. Please be aware that the stress of moving to a new home, exposure to other animals or new environments, changes in diet and water can trigger these maladies so once the puppy leaves our property we no longer guarantee against Coccidian, Giardia, kennel Cough, worms, fleas, ticks, ear mites, or parasites of any kind.
Genetics
Your dog is guaranteed to be free of life threatening genetic defects of the heart liver and kidneys, hereditary eye problems such as juvenile cataracts and hereditary and congenital hip dysplasia. Life-threatening is defined as a genetic abnormality/disorder that will eventually cause the early death of the dog with life expectancy of less than 5 years either by the progression of the disease or by recommended euthanasia unless extensive medical care and surgery are performed beyond the cost of said puppy. In the unlikely event that your dog is diagnosed by a licensed veterinarian with any of these hereditary defects, a replacement dog of the same price, same quality, same sex, same color, same size as the dog originally purchased (unless otherwise agreed upon by the purchaser and seller) will be given when the dog is available. In order to qualify for a replacement dog the purchaser must notify the seller immediately of the situation and send a copy of the vet report, OFA or CERF to Beni Babies. All claims must be submitted prior to the puppies second birthday.
In all cases we reserve the right to have the dog examined by our veterinarian. If the examination of the alleged defect, by a licensed veterinarian of seller's choice determines that the defect is not genetic, but caused by trauma, stress, neglect, poor diet, abuse, or any not inherited factor, this guarantee is null and void, without effect, and will not be honored. If an examination by our vet is refused by the buyer this guarantee is null and void.
In the unlikely event of death, a necropsy must be performed by a licensed veterinarian and a copy of the report forwarded to Seller for review by Seller's veterinarian before determining if a replacement is to be made. If our veterinarian concurs that the puppy did indeed pass away due a genetic defect, we will replace your puppy as soon as one is available. All expenses are at Buyer's expense including the licensed veterinarian tests, professional diagnosis and necropsy, if applicable, as well as the return shipping and shipping of the replacement puppy. If the puppy becomes ill and the owner has the puppy euthanized without our prior consent, no replacement will be made. If the Buyer declines a replacement puppy, then Seller shall be under no further obligation and it will be deemed that the Buyer has released the Seller from any and all further claims, obligations or duty on this agreement. SELLER SHALL NOT BE RESPONSIBLE FOR MEDICAL EXPENSES OR OTHER COSTS THAT BUYER HAS INCURRED. This guarantee does NOT cover any costs associated with spaying or neutering, nor does it cover injury or death from any routine surgical procedure.
Seller simply cannot ensure the overall health of the puppy if it is provided poor nutrition and consumes harmful preservatives/chemicals or a diet that lacks proper nourishment. While genetics account for only 35% of a dog’s performance, the remaining 65% nutrition. We strongly caution you to check ingredients of dog food for the entire life of your dog to ensure longevity and long-term health of your dog. Purchaser agrees to maintain this dog in a healthy environment at all times. This includes adequate grain/corn/soy/bean/vegetable protein free food with no less than 80% animal source meat, clean fresh water, proper exercise and access to outdoors, and medical care. Purchaser agrees to use NuVet supplements for the duration of this health guarantee. (You can find a link to NuVet on our website). Purchaser agrees to maintain this dog in a healthy environment at all times. This includes adequate grain/corn/soy/bean/vegetable protein free food with no less than 80% animal source meat, clean fresh water, proper exercise and access to outdoors, and medical care.
Purchaser agrees to keep this dog under control at all times and socialize it with humans and other animals. Seller will not be held responsible for any damages caused directly or indirectly by this dog to property, humans, or animals. Full time caging or kenneling is strictly forbidden.
Purchaser agrees to give seller 30 day notification of intent to sell or give away this dog and to give seller first right of refusal for purchasing this dog at a price equal to that which it would be offered to the general public. Seller will be given a total of 30 days to respond and to pay the agreed upon price. PURCHASER AGREES TO NEVER SELL OR GIVE THIS DOG TO ANY PET STORE, ANIMAL SHELTER, DOG DEALER, RESCUE, RESEARCH LABORATORY OR BROKER.
Vaccines
ALL VACCINES COMES WITH SIDE EFFECTS, some are minor and others can be life threatening. All vaccines are NOT created equal; therefore, you will need to do research regarding each vaccine. We recommend your research being independent of any influencing parties including veterinarians. Because over vaccination can cause serious health consequences, any vaccination given before your puppy is actually due for its next vaccine will VOID this guarantee in its entirety. It is the Buyer’s responsibility to set up an ongoing appropriate vaccination schedule with your vet. We assume no responsibility for injuries or side effects caused by any vaccines.
The seller does not assume responsibility for any side effects of any medications administered by the buyer or veterinarian after the puppy leaves our property.
The seller reserves the exclusive rights to cancel this agreement before the dog is picked up and return all moneys if for any reason whatsoever, seller determines that the sale of the said dog is not in the best interest of the dog. Any and all deposits or payments are non refundable if purchaser decides not to take the dog.
This contract is designed to protect the purchaser, seller, and dog.
